Introduction

By purchasing and utilizing our services, you agree to the following terms and conditions. 

Use of Virtual Coaching Platform and Website

You will use our website for lawful purposes only. You shall not:

  • Violate any applicable regulations or laws

  • Engage in illegal, harmful, abusive, or fraudulent activities 

  • Attempt to compromise the security or functionality of the website 

 

Upon creating an account on our website, you are responsible for the confidentiality of your login credentials, and will notify us immediately if they have been compromised. 

Eligibility

By accessing our services, you confirm that you are over the age of eighteen years old, or have consent from your parent/guardian. In addition, you confirm that you or your guardian have full power, capacity, and authority to agree to the terms and conditions, liability forms, and eligibility questionnaires, and have not been previously banned from using the platform. 

Payment

All payments for services are made as upfront fixed term packages. 

 

Packages/subscriptions will not auto renew unless autorenewal is opted into. 

Refunds/Cancellation 

Under no circumstances will refunds be given for a period of time already passed.

 

Cancellations and/or freezes of plans that have not reached their completion date may be granted on a case by case basis at our discretion, in the event of unforeseen personal circumstances. In these instances, if a refund or freeze is granted, it will only apply to the period of time remaining in the package, not that which has already passed.   

 
In order to request to freeze or cancel you must email wally@sweatandjoy.ca and include: 

  • Your name

  • Your email address associated with your account

  • Specification of request for either freeze or cancellation 

  • Reason for request 

Liability

In using our services, you assume all personal risk and responsibility. We do not accept any liability for illness or injury sustained during or after using our services. 

Medical Disclaimer

We are not medical professionals, and do not give medical advice, diagnosis, or treatment. In using our services, you acknowledge and agree that no advice or information provided during services should be taken as medical advice, or as a substitute for treatment from a medical professional. 

Payments and Purchases

All purchases/payments made through our website/online payment platform are subject to our refund and billing policies. We reserve the right to cancel any payment at our discretion. 

Limitation of Liability

We are not liable for any incidental, indirect, or consequential damages resulting from the use of our website or services. We do not guarantee error free or uninterrupted access to our services. 

Third Party Links

We are not responsible for the practices, policies, or content of any third party/external sites linked from or to our website. 

Termination 

We reserve the right to suspend or terminate access to our website/virtual coaching platform/services at any time, without prior notice, if these terms and conditions are violated. 

Jurisdiction 

These terms and conditions are governed by the laws of British Columbia, Canada, and any disputes arising from or related to this agreement shall be settled in the courts of British Columbia. 

Changes to Terms

We reserve the right to update these terms and conditions at any time. An updated effective date will also be posted on this page. Continued use of our website/virtual coaching platform/services constitutes acceptance of the revised terms.
